Today the
Sacramento Bee published an article about Reynen and Bardis'
failure to fix our home. In the article Francis Furtado stated
"... his firm intends to repair those homes, but McGuire, whose
house was the first on the street to have problems, has not allowed
workers to fix it as they see fit. He has hired an engineer to make
recommendations about how the house should be repaired and said
Reynen & Bardis won't abide by those suggestions." What is
very interesting is that we both have the same engineering firm
Youngdahl
Consulting. Reynen and Bardis have used Youngdahl for
recommendation of how to correct the problem with other homes.
The issue is since we have paid Youngdahl he has given us the
reports and Reynen and Bardis can not skip steps. We know what
has actually been recommended and we will hold Reynen and Bardis to
it. We have educated ourselves, we have gone public and both
of those things scare Reynen and Bardis. The open invitation
to Reynen and Bardis still stands "come fix our home per your
engineer's report (Youngdahl)"

A news article on
ranchomurieta.com was just published. In it Francis
Furtado is quoted as saying "Furtado said the offer to fix the
home's problems still stands. "Just let us come in, we'll use our
consultants and do what's right to get it fixed. (Matt McGuire) has
not given us the OK to do that.". This is a complete lie.
Francis show me where I ever said you could not come in and fix our
home? Reynen and Bardis has told our lawyer they will not fix our
home. If Reynen and Bardis is willing to fix our home then I
invite them to call us and set up a schedule. All we want is
our home fixed per the engineers reports. (our engineer is
also their engineer so there is no discrepancy as to what needs to
be done.) So Francis stand by your word and come fix our home.

Homebuilder loses slander lawsuit -
A lawsuit backfired on a Cherokee County homebuilder who sued a
customer for complaining that work on his home was unfinished and
shoddy. Builder Kathy Nicotra sued Don Akridge for slander and
interfering with her business, but Akridge fought back, countersuing
Nicotra for breach of contract and warranty and negligent
construction of his $485,000 home in the Lake Sovereign
neighborhood. A Cherokee County Superior Court jury sided with
Akridge last month, finding that he did not slander Nicotra. The
jury awarded him $36,000 for his claims.

We have been told by
prospective home buyers that Reynen and Bardis have told them that
all new homes have a post tension foundation and that it will solve
the cracking issues. Well we have a post tension foundation
and it did not stop our foundation from heaving and our walls from
cracking.

After review by a civil rights lawyer and the
ACLU we have decided
to put this site back online. This site is protected by our
first amendment rights. The First Amendment was created by
American's founders to protect the individual's rights, two of these
rights being freedom of speech and freedom of expression.
Unfortunately Reynen and Bardis has chosen to threaten us with
lawsuits rather than fix our home. If Reynen and Bardis wants
to turn this into a federal civil rights case (and the publicity that
comes along with such a case) we are ready for the ride.

This site has been taken offline while we
consult with our attorney. Reynen and Bardis has threatened to
sue us for defamation.

government officials, and lawyers, found those defects and more in
many new or young homes. Faulty foundations, serious moisture
intrusion, and shoddy framing are often at the root of problems,
which manifest themselves as gaping cracks,
rotting walls, and windows and doors that don’t close right. Often,
though, they show up months or even years after the buyer has moved
in and the builder has moved on."

We are getting a bunch of emails asking if
Reynen and Bardis has fixed our home yet. The answer is NO.
We have almost been in our home 1 year and we still have our
structural damage. I have spoke with John Reynen and
Francis Furtado (President of home building operations) directly and
they assured me my home would be fixed, that was months ago.

Schwarzenegger. We have asked him to please, think of his
constituents and DO NOT HALT REGULATIONS, but rather take measures
to ensure enforcement and accountability.

We have moved to a new
server with a new hosting provider. We have been getting so
many hits that the old server was just too slow.

In
California, the time for an owner to bring a claim for faulty
construction (negligence) is set by statute. The most commonly
applied time period is three years from the date the homeowner
discovers the problem. A question often disputed is when did the
three-year period start to run. The three-year "clock" begins to
tick from the time when the owner "knew or should have known" of
faulty or incomplete construction. To be safe, notify your builder
as soon as you suspect a problem.
Does
simply informing the contractor of a problem stop the running of the
clock? NO.
The only
thing that stops the running of your statute of limitations is the
filing of a lawsuit or obtaining a written waiver from the
contractor. As a result, agreements by a builder to correct a
condition may be worthless if the condition is not in fact corrected
and three years pass. Once the three-year period has passed, the
owner has no more teeth with which to compel performance by the
contractor since after that time, the contractor is no longer
subject to legal action to fix the problem. Be leery, many bad
builders will do all they can, make false promises, delays, and
missed appointments knowing these statutes and time limits better
than you!

The 2003 JD Power results are out and
Reynen and Bardis scored 19th out of 26 area home builders. Their lowest score was for quality of workmanship.
